Former “Empire” star Jussie Smollett was indicted Tuesday by special prosecutor Dan Webb. Smollett initially filed a false police report in January 2019, claiming to be the victim of a hate crime.

Webb stated a Cook County grand jury returned a six-count indictment charging Smollett with “making four separate false reports to Chicago Police Department officers related to his false claims that he was the victim of a hate crime, knowing that he was not the victim of a crime.” Webb added the investigation concluded, “further prosecution of Jussie Smollet is in the interest of justice.”

Smollett told Chicago police in January 2019 he received a threatening letter. A week later, the gay black actor claimed he was the victim of a racist and homophobic attack after two men jumped him, poured a chemical on him, and put a noose around his neck as they yelled racial and homophobic slurs at him. Smollett claimed the attackers said, “This is MAGA country.”

Smollett was indicted with 16 felony counts by a Cook County grand jury, but State Attorney for Cook County Kim Foxx dropped all the charges without any explanation. Smollett agreed to let the city keep $10,000 of his bail money and promised to perform 16 hours of community service. The dismissal of the charges got significant backlash from higher authorities, including the Police Superintendent Eddie Johnson and then-Chicago Mayor Rahm Emanuel.

On Tuesday, Webb stated his office had “sufficient factual evidence to determine that it disagrees with how the Cook County State’s attorney office resolved the case.”

“Based on the recommendation of the OSP (Office of the Special Prosecutor), a Cook County grand jury returned a six-count indictment charging Jussie Smollett with making four separate false reports to Chicago Police Department officers related to his false claims that he was the victim of a hate crime, knowing that he was not the victim of a crime,” said Webb in a statement.

“The Cook County State’s Attorney’s office charged Jussie Smollett with multiple counts, and today the Special Prosecutor did the same,” said Webb.

Police said that Smollett paid two brothers $3,500 to stage the attack. According to the police department, they were able to provide proof of the brothers conspired an alleged attack on Smollett with video evidence and text messages.

Smollett’s attorney claims the new charges are about politics and not justice.

Rep. Adam Schiff defended Smollett, but deleted his tweet after news broke of the new charges against Smollett.
